1. Acceptance of Terms
By accessing and using RemoteTips.com ("RemoteTips," "Platform," "Service," "we," "us," or "our"), a brand owned and operated by Exceptionly, Inc. ("Company"), a Delaware corporation, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, you must not access or use our services.

3. Nature of the Platform (Venue Only)
You acknowledge that RemoteTips serves strictly as a venue and a technical tool.
- For Candidates: We provide a searchable database of job opportunities and tools to automate or facilitate applications.
- For Employers: We provide a platform to list job openings.
Exceptionly, Inc. is not an employment agency, staffing firm, or recruiting firm in the context of RemoteTips.com. We do not screen or censor the listings, including profiles offered. We are not involved in the actual transaction between employers and candidates. As a result, we have no control over the quality, safety, or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates, or the ability of candidates to fill job openings.
4. No Responsibility for Content or Outcomes
To the fullest extent permitted by law:
- Job Content: We assume no responsibility for jobs added to our platform. We do not verify the identity of employers or the validity of job offers. You acknowledge that user-generated content may be inaccurate or misleading, and you agree to use caution.
- Application Tools (Auto/Manual): We assume no responsibility for the success, delivery, or processing of automatic or manual job applications performed by candidates on our platform. We do not guarantee that an employer will receive, open, read, or respond to an application sent through RemoteTips.
- Hiring Outcomes: We do not guarantee that you will be hired or that you will find a candidate. We are not responsible for any employment decisions made by any user.
5. User Accounts
To access certain features, you must register for an account. You agree to:
- Provide accurate, current, and complete information.
- Maintain the security of your password.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use.
6. Employer Obligations
If you post jobs on RemoteTips, you represent and warrant that:
- Your job postings comply with all applicable laws, including labor and anti-discrimination laws.
- The jobs represent bona fide employment opportunities.
- You are not posting fraudulent, multi-level marketing (MLM), or "get rich quick" schemes.
- You indemnify Exceptionly, Inc. against any claims arising from your job postings.
7. Candidate Obligations
If you use RemoteTips to apply for jobs, you agree to:
- Provide truthful information in your profile and applications.
- Use the automated application tools only for legitimate job seeking.
- Acknowledge that any employment relationship formed is solely between you and the employer.
8. Subscriptions and Payments
- Billing: Subscription services are billed on a recurring basis (monthly or annually) via our payment processor (Stripe).
- No Refunds: Payments are non-refundable except as required by applicable law.
- Cancellations: You may cancel your subscription at any time via your account settings. Access remains until the end of the current billing cycle.
9. Intellectual Property
The RemoteTips platform, design, logos, and code are the property of Exceptionly, Inc. You grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute any content you post (e.g., job descriptions, resumes) for the purpose of operating the Service.
10. Prohibited Conduct
You agree not to:
- Scrape, spider, or crawl the Platform (except for general purpose search engines).
- Post false or misleading information.
- Harass or harm other users.
- Reverse engineer the Service.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." EXCEPTIONLY, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
12. Limitation of Liability
IN NO EVENT SHALL EXCEPTIONLY, INC., ITS AFFILIATES, OR THEIR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
13. Indemnification
You agree to defend, indemnify, and hold harmless Exceptionly, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or your violation of these Terms.
14. Dispute Resolution; Choice of Law
- Governing Law: These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law principles.
- Arbitration: To the maximum extent permitted by law, all disputes arising under or in connection with these Terms shall be submitted to Judicial Arbitration and Mediation Services, Inc. ("JAMS") for binding arbitration in Wilmington, Delaware, by a single arbitrator. The arbitration shall be conducted under the Delaware Uniform Arbitration Act.
- Jurisdiction: If a matter is not arbitrable, the federal or state courts sitting in Delaware shall have exclusive jurisdiction.
15. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the Service constitutes acceptance of the new terms.
